DESCRIPTION

The Les Toises teleconsultation application is designed to enable you to consult therapists2 from the Les Toises Psychiatry and Psychotherapy Center remotely, in complete security and confidentiality. This application is the material and intellectual property of Les Toises AG. The general terms and conditions of use are governed by Swiss law. Only Swiss law is applicable, and the place of jurisdiction is Lausanne (Switzerland).

USE

You (or your child or a protected adult3) can use the Les Toises teleconsultation application after registering online. Appointments are made online with a therapist at Les Toises Psychiatric and Psychotherapy Center. As teleconsultation is not an appropriate means of managing emergency psychiatric care, the shortest time between booking an appointment and the teleconsultation appointment is 72 hours. This allows you to be seen urgently in an appropriate structure for care adapted to this specific situation (psychiatric emergency center, hospital, clinic, consulting room, etc.). If you have any doubts that teleconsultation may not be appropriate in your situation, we invite you to discuss this with a doctor of your choice (GP, specialist, etc.). If you are in the vicinity of one of the Les Toises psychiatric and psychotherapy centers, you can also book a consultation appointment and put your question directly to the therapist who will be looking after you.

Prior to any teleconsultation, you, your child or a protected adult must consent to remote care, to the processing of your personal data, and to the general conditions of use which are the subject of this text. We strongly recommend that you watch the short video which will familiarize you with the conditions of remote consultation: choice of consultation location, equipment required, and any other information that will enable you to consult remotely in complete safety and confidentiality. You will also have access to a contact form in case of technical problems.

SPECIAL CASE OF TELECONSULTATIONS FOR CHILDREN AND ADULTS UNDER GUARDIANSHIP

If the teleconsultation is intended for your child or a protected adult, you will need to enter the details of your child or protected adult when creating your personal account. Only the login or contact details (e-mail address or cell phone) can be yours. Depending on the age of your child or adult, it is possible to create the account with their own e-mail address or cell phone, but in this case you will no longer have access to the account. For the first teleconsultation with your child or protected adult, at least one parent (or guardian) must be present. For subsequent consultations, you must be close by and available if necessary. You must be able to intervene with your child or protected adult quickly in the event of an emergency signaled by the therapist on your cell phone. Before subsequent consultations, you must provide the therapist in charge of your child or protected adult with your cell phone number, and undertake to check that the phone is switched on during teleconsultations.

DATA SECURITY

The Les Toises teleconsultation application complies with data protection regulations, in particular the Swiss Federal Data Protection Act (DPA) and the corresponding ordinances. Personal data is any information that refers to an identified or identifiable person, and includes in particular data concerning your health. The provisions of medical and professional secrecy apply to all data collected.

Les Toises AG, owner of the Les Toises teleconsultation application, processes your personal data as the organization responsible for providing the remote care service you request via the application, and undertakes to ensure the security of the systems and programs under its control, in accordance with the current state of the art. Users are aware that errors may occur despite the care taken in software development and maintenance. For this reason, the Les Toises teleconsultation application cannot guarantee 100% availability of the service, and every effort is made to come as close as possible.

The purpose of processing your personal data is to identify you when you log on, to manage your profile and to enable therapists to offer you remote treatment, to provide health insurance companies with information enabling them to cover the cost of treatment, or an invoice enabling you to contact your insurer in the case of direct payment via the teleconsultation application, and more generally to answer your questions about using the service and to improve your user experience.

The Les Toises teleconsultation application draws users' attention to the fact that communication with the therapist by means other than the application (e-mail, public messaging or video systems, social networks, etc.) is neither secure nor confidential. The company declines all responsibility for any harm resulting from communication by these other means. Users are asked not to communicate information that is sensitive in terms of data protection or personality via these other means.

When you register, to be able to use the Les Toises teleconsultation application, you will need a valid e-mail address and health insurance details for the country in which you are insured, if applicable. Please note that some health insurance policies do not cover teleconsultations. You must check with your health insurer and agree to pay the costs of using the Les Toises teleconsultation application yourself, without being certain that your health insurance will cover the costs.

If you are a member of an international health insurance scheme, you can send your receipted invoice directly to your insurance company, so as to obtain financial coverage for your treatment, where applicable, depending on the terms of your insurance contract. Other data collected on the application are your cell phone number, which is essential for securing your account using a two-factor authentication process that can be deactivated depending on the country in which you reside, and the surname, first name and cell phone number of a trusted third party, who can be contacted in an emergency under the conditions defined in the consent to remote care.

IF THE USER IS A THERAPIST

As a therapist using the Les Toises teleconsultation application, the data collected is different from that of other users. No data concerning your health insurance is collected. The data collected and processed by the Les Toises teleconsultation application concerns your identity, your training, your diplomas, as well as any information concerning your practice as a therapist, and your hours and days of availability for teleconsultations.
